About the Organization

Due Process Institute is a bipartisan nonprofit organization dedicated to honoring, preserving, and restoring principles of fairness and procedural due process within the American criminal legal system. It advances constitutional protections through advocacy, legislative engagement, litigation, and public education, working across ideological lines to promote transparency, accountability, and equitable treatment under the law.

Policy Goals

Federal and state criminal justice reform, sentencing reform, overcriminalization, civil asset forfeiture reform, supervised release reform, second chance and record sealing legislation, prison oversight and reentry policy, surveillance reform under FISA Section 702, and broader constitutional due process protections.

Funding

Primarily funded through individual contributions and philanthropic support; operates as a 501(c)(4) social welfare organization with a related 501(c)(3) sister foundation supporting educational and charitable efforts.

Affiliates

Clause 40 Foundation; affiliated leadership includes Founder and President Shana O'Toole and Vice President Jason Pye; collaborates with bipartisan coalitions and organizations such as FAMM, Justice Action Network, R Street Institute, and other civil liberties and criminal justice reform groups.
